DMCA Policy

Heartbreak High Wiki respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to us. This policy describes the information that should be present in a DMCA notice and counter-notification.

Filing a DMCA Notice

If you believe that your copyrighted work has been copied and posted on Heartbreak High Wiki in a way that constitutes copyright infringement, please provide our Copyright Agent with a written notice containing the following information:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (web page address) where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material on Heartbreak High Wiki that you claim is infringing and needs to be removed or access to which needs to be disabled, including its URL (if applicable) and a description of where the infringing material is located on the site.
  4. Your address, telephone number, and email address.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that your content was removed by mistake or misidentification, you may send us a counter-notification. When we receive a valid counter-notification, we will forward a copy to the complaining party. If the complaining party does not file an action in court within 10-14 business days, we may restore the removed content. Your counter-notification must include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Heartbreak High Wiki may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
